Well, I received my Fully Favorable letter in December, 2007, received my first monthly SSDI check in January, 2008, but still haven't seen a penny of back pay. Neither has my son, who received his first DAC payment off my record in February, 2008. In fact, they have been trying their best to cheat him out of his rightful back pay.

When he first filed in 2005, he filed on his dad's record. We told them his mother was filing too, but they wouldn't let him file on hers because "her's wasn't approved yet". So we told them that when mom was approved, we wanted to update the DAC filing to change the father's name to the mother's. I don't remember if they said OK, or if they just kept their mouths shut. SSA wouldn't let him file on mom until she received her award letter in December, 2007 and we went down there the next day. No, he has to file a new DAC claim, he can't change the original one from the dad's name to the mom's according to SSA. Then they decided his back pay would come off his father's record "because he didn't file on hers until Dec 2007". Duh. And the reason was????? Sorry, I digress. (Mom's SSDI is much larger than dad's, which is why this is important.)

Our lawyer's office has been talking to the payment center for over 2 months now. The 1st payment center clerk understood the issues, was very knowledgeable, and knew son should get back pay off the mom's record. Then, suddenly, this lady was "gone", whether she retired, or just got taken off our case, who knows. In her place was a new, untrained, rude and obnoxious person, who almost convinced the lawyer's office that my son wasn't entitled to back pay off his mom's record. But she was so obnoxious the lawyers office insisted on speaking to a supervisor. Who initially agreed with the clerk. BUT, decided to go "check something" on mom's claim. When he came back, he said mom had "protected the son's filing" by how she filed her claim, and that son will indeed get back pay off the mom's record.

I told the lawyer's office that they were worth every penny of the 25% we have to pay them. Never could I have gone up against the SSA payment center for month after month with them telling me all kinds of wrong information. Emotionally could not deal with anyone obnoxious at all. I would have given up long ago, which is what I guess they are expecting.

I know this is confusing. Dad got on SSDI about 2000. Then son filed and was approved for SSI. Then son filed for DAC on dad's record. Then mom filed for SSDI. Then mom was approved for SSDI. Then son was approved for DAC . Then SSA made son file a new claim for DAC on mom's record. Mom and son's entitlement dates both go back to 2004, and onset dates are way before 2004.

The magic words on mom's SSDI filing were these:
I HAVE THE FOLLOWING CHILD OR CHILDREN UNDER AGE 18; AGE 18-19 ATTENDING ELEMENTARY OR SECONDARY SCHOOL FULL TIME; OR AGE 18 OR OVER AND DISABLED BEFORE AGE 22 WHO MAY BE ELIGIBLE FOR SOCIAL SECURITY BENEFITS ON THIS RECORD. THIS INCLUDES CHILDREN WHO MAY OR MAY NOT BE LIVING WITH ME. Then my son's name is listed.

If that statement had not been in my filing, they would have kept several thousand $$ that he was entitled to. However, I suspect some poor clerk may get reprimanded for this, as our combined back pay will be significant, even after lawyer fees, and after he pays back every cent of the SSI he received.

On other boards, it appears that those with large back pay amounts have to wait a year or longer for their back pay. I'm glad now I didn't go ahead and make purchases. Never would I have thought that I would still be waiting on back pay after this long. SSA has already accumulated several hundred dollars of interest that SHOULD be in my bank account, but never will be.

I'm so tired of all this, and hope that others get their back pay much sooner, and with much less hassle than this has been for me. I truly appreciate my lawyer more and more each day. I am very grateful that I am receiving the monthly checks, at least the struggle of paying my monthly bills has gone away, and I'm paying partial payments on the bills I accumulated. Had hoped to have the money to pay them all off by now, but that is obviously not part of the universe's plan for me. Sigh.
